Public Library of Law

The Public Library of Law (PLoL) provides free online access to extensive primary sources of U.S. law. The searchable case law database includes all U.S. Supreme Court opinions, federal circuit court opinions from 1950 to the present, and state supreme and appellate court cases from 1997 to the present. When researching case law, PLoL allows advanced Boolean searching, narrowing by jurisdiction, and exact citation or docket number look up. Free registration is required to view judicial opinions. These resources are fed into the PLoL website from their most authoritative free online location. This allows users to research multiple jurisdictions without navigating to each state's individual website.

Utility Pole Collision Case

In Turner v. Ohio Bell Tel. Co., the Ohio Supreme Court ruled yesterday that when a vehicle collides with a utility pole located off the improved portion of a roadway but within the right-of-way, a public utility is not liable as a matter of law if the utility has obtained any necessary permission to install the pole and the pole does not interfere with the usual and ordinary course of travel.

Liquor License Transfer Case

In City of Cleveland v. Fast & Friendly, Inc., the 10th District Court of Appeals ruled that Fast & Friendly could transfer its liquor license to a location across from an elementary school. The City of Cleveland had appealed the the decision of a Franklin County common pleas judge who upheld an order of the Ohio Liquor Control Commission.  Appellate Judge Susan Brown said the city's testimony was minimal, general, and speculative, and insufficient to establish substantial interference with public decency, sobriety, peace, or good order.

Genetic Non-Discrimination Act

The U.S. Congress May 1 approved legislation (H.R. 493) that would outlaw genetic discrimination in the workplace, sending the measure to President Bush, who has said he will sign it. The Genetic Information Non-Discrimination Act would prohibit employers from discharging, refusing to hire, or otherwise discriminating against employees on the basis of genetic information. The measure aims to eliminate any fear of discrimination held by those who now decline to undergo potentially beneficial genetic tests. The measure also would preclude discrimination by group health plans based on genetic information and would prohibit insurers from requiring genetic tests.
